Special Education/ Exceptional Child Education

A variety of special education services are provided by Elliott County Schools to students from age 3-21.  If your child does not receive special education services and you feel that he/she may require them to succeed within the general curriculum, contact your child’s teacher or principal to discuss interventions and/or a referral.  It is now required that students undergo a period of research-based interventions before being assessed for special education services.

Special education services are provided specifically to students with disabilities.  Services are provided for students in the categorical areas listed below, in accordance with IDEA:

Children eligible for 504 services include those children who have a current physical/medical or mental impairment that currently substantially limits some major life activity, which causes the student’s ability to access the school environment or school activities to be substantially limited.


The Elliott County School District has an ongoing “Child Find” system, which is designed to locate, identify and evaluate any child residing in a home, facility, or residence within its geographical boundaries, age three (3) to twenty-one (21) years who may have a disability and be in need of Special Education or 504 services. This includes children who are not in school; those who are in public, private, or home school; those who are highly mobile such as children who are migrant or homeless; and those who are advancing from grade to grade.

The Elliott County School District will make sure any child enrolled in its district who qualifies for Special Education or 504 services, regardless of how severe the disability, is provided appropriate Special Education or 504 services at no cost to the parents of the child.

Parents, relatives, public and private agency employees, and concerned citizens are invited to help the Elliott County School District find any child who may have a disability and need Special Education or 504 services. Letters and phone calls are some of the ways the Elliott County School District collects the information needed. The information the school District collects will be used to contact the parents of the child and find out if the child needs to be evaluated or referred for Special Education or 504 services.

FERPA ensures parents/ guardians the right to inspect and review the student’s education records within 45 days after the day the school receives a request for access.  A student/ parent should submit to the principal a request that identifies the record(s) the student wishes to inspect.  The school official will make arrangements for access and notify the student/ parent of the time and place where the records may be inspected.  If the records are not maintained by the school official to whom the request was submitted, that official shall advise the student/ parent of the correct official to whom the request should be addressed if applicable.

FERPA ensures the right to request the amendment of the student’s education records that the student believes is inaccurate, misleading, or otherwise in violation of the student’s privacy rights under FERPA.

A student/ parent who wishes to ask the school to amend a record should write the school official responsible for the record, clearly identify the part of the record the student wants changed, and specify why it should be changed.

If the school decides not to amend the record as requested, the school will notify the student in writing of the decision and the student’s right to a hearing re­garding the request for amendment.  Additional information regarding the hearing procedures will be provided to the student when notified of the right to a hearing.

The Principal or Superintendent is authorized to release Board approved directory information.  Approved “directory information” shall be: student names and addresses, telephone numbers, date and place of birth, student’s school email address, major field of study, participation in officially recognized activities and sports, photograph/picture, grade level, weight and height of members of athletic teams, dates of attendance, degrees and awards received, and most recent educational institution attended by student.

Any eligible student, parent, or guardian who does not wish to have directory information released shall notify the Superintendent in writing within thirty (30) calendar days after receiving notification of FERPA rights.

The District allows for disclosure of directory information only to specific parties for specific purposes. Such limitations are specified in the student directory information notification.

Unless the parent/guardian or secondary school student requests in writing that the District not release such information, the student’s name, address, and telephone number (if listed) shall be released to Armed Forces recruiters upon their request.

The school discloses education records without a student’s prior written consent under the FERPA exception for disclosure to school officials with legitimate educational interests. Special education records may be destroyed after three years if they are no longer needed in the education of the child.
